These Terms of Use (this “Agreement”) are a legal contract between you (“you” or the “User”) and Develife that governs your use of the App and related services (collectively, the “Services”). By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement and our Privacy Policy available at  http://habbit-ok.tilda.ws/privacy-policy. If you do not agree, do not use the App.

1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country). If you are between 13 and 18, you may use the App only with permission of a parent or legal guardian who agrees to this Agreement.


2. License and Ownership
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on devices you own or control for your personal, non-commercial use.
All rights not expressly granted are reserved by Develife and its licensors. The App and all content therein are protected by intellectual property laws.

3. License Restrictions
You must not: (a) copy, modify, translate, adapt, or create derivative works of the App; (b) reverse engineer, decompile, or attempt to extract source code; (c) rent, lease, sell, sublicense, or otherwise transfer the App; (d) circumvent or interfere with security or usage limits; (e) use the App for unlawful, harmful, or misleading purposes; (f) scrape or collect data from the App except as permitted by its intended functionality.

4. Account and Data
You are responsible for the accuracy of information you provide and for maintaining the confidentiality of your device and any credentials. You are responsible for all activity under your account or device. Our processing of personal data is described in the Privacy Policy http://habbit-ok.tilda.ws/privacy-policy.

5. Subscriptions, Trials, Billing, and Cancellation (In-App Purchase)
Some features are available through auto-renewing subscriptions purchased via Apple’s in-app purchase system.

• Billing. Payment will be charged to your Apple ID at confirmation of purchase.
• Auto-renewal. Subscriptions renew automatically for the same period and price unless canceled at least 24 hours before the end of the current period.
• Manage & Cancel. You can manage and cancel your subscription at any time in Settings → Apple ID → Subscriptions on your device. After cancellation, access continues until the current period ends.
• Trials. If a free trial is offered, unused portions are forfeited when you purchase a subscription. Trials convert to a paid plan unless canceled at least 24 hours before trial end.
• Price changes. We may change prices or plans. If required by Apple, you will be notified and asked to accept the new price; otherwise you may cancel in your Apple ID settings.
• Refunds. Payments are processed by Apple. Refunds are handled by Apple according to their policies; contact Apple Support for refund requests, except where mandatory law requires otherwise.
• Taxes. Prices may include applicable taxes as determined by the store.

6. User Content
You may input data such as habits, notes, and goals (“User Content”). You retain your rights to your User Content. By using the Services, you grant us a limited license to host, process, and display User Content solely to operate and improve the Services. You are responsible for the legality and accuracy of your User Content and must not submit content that is illegal, infringing, or harmful.

7. Health/Wellness Disclaimer
The App provides habit tracking and productivity features for informational purposes only. It is not medical or mental-health advice and does not diagnose, treat, or prevent any disease. Always seek the advice of a qualified professional for health-related questions. Use of the App is at your own discretion and risk.

8. Third-Party Services
The Services may integrate third-party services (e.g., analytics, links). We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

9. Prohibited Conduct
You agree not to: (a) use the Services in violation of laws; (b) attempt to gain unauthorized access; (c) interfere with operation or security; (d) upload malware; (e) harass or harm others; (f) misrepresent your identity; (g) use the Services to build a competing product.

10. Termination
We may suspend or terminate your access at any time if you violate this Agreement or if required by law. You may stop using the App and cancel subscriptions at any time via your Apple ID settings. Upon termination, the license granted to you ends and you must cease all use.

11. Changes to the Services and to this Agreement
We may modify or discontinue features at any time. We may update this Agreement by posting a new version with an updated “Effective date.” If changes are material, we may provide additional notice. Continued use after changes means you accept the updated terms.

12. Disclaimers
THE APP AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVELIFE AND ITS DIRECTORS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP OR SUBSCRIPTION DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY (OR, IF NONE, USD $10).

14. Indemnification
You agree to indemnify and hold Develife harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of this Agreement.

15. Consumers in the EU/UK
If you reside in the EU/UK, you may have statutory consumer rights that cannot be waived. Nothing in this Agreement limits those rights. If you purchased through Apple, your right of withdrawal may not apply once digital content is delivered with your prior consent.

16. Apple-Specific Terms (iOS Users)
You acknowledge that this Agreement is between you and Develife only, not Apple. Apple has no obligation to provide maintenance or support for the App. To the extent any warranty exists, Develife—not Apple—is responsible. Apple is not responsible for addressing any claims relating to the App or your possession/use of it, including product liability, legal compliance, or IP claims. You represent that you are not in a country subject to US government embargo or on any restricted list. Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.

17. Miscellaneous
If any provision is found unenforceable, the remaining provisions remain in full force. You may not assign this Agreement; we may assign it in connection with a merger, sale, or reorganization. No waiver is effective unless in writing. Headings are for convenience only.
